Terms of Use

These terms govern your use of the Redactly app and this website. They are written to be read, not to be skipped.

01Agreement to these terms

These Terms of Use (the “Terms”) form an agreement between you and Piyush Shiyani (“we”, “us”) covering the Redactly iPhone application (the “App”) and this website (the “Site”, together the “Service”).

By downloading, installing or using the App, or by using the Site, you agree to these Terms. If you do not agree to them, do not use the Service.

The App is distributed through the Apple App Store, so Apple’s Media Services Terms and Conditions also apply to your download and use of it. Where those terms and these Terms conflict on a matter Apple governs, Apple’s terms control.

02Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices you own or control, in accordance with the Apple Media Services Terms and with these Terms. This is a licence to use the App, not a sale of it; we and our licensors retain all rights not expressly granted.

You may not:

  • Copy, sell, rent, sublicense, lease or otherwise distribute the App.
  • Reverse engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits it despite this restriction.
  • Remove, obscure or alter any proprietary notice, branding or attribution in the App.
  • Use the App in any way that violates applicable law, or that infringes anyone's rights.

03Price and in-app purchases

Redactly 1.0 is provided free of charge. It contains no in-app purchases, no subscription, no advertising, no watermark and no limit on the length or number of videos you process.

We may introduce paid features in a future version. If we do, the terms of any such purchase will be presented clearly at the point of purchase and handled by Apple, and no feature that is free today will be retroactively removed from a version you have already installed.

04Your content

The videos you process with Redactly are yours. We claim no ownership, licence or interest in them whatsoever.

Because all processing happens on your device and nothing is uploaded, we never receive, store, view or have any access to your content. See our Privacy Policy for the detail.

You are solely responsible for the content you process and for what you do with the result — including whether you have the right to record, hold, redact, publish or distribute it.

05Acceptable use

You agree not to use the Service to:

  • Process content you have no lawful right to possess or handle.
  • Conceal, destroy or tamper with evidence, or to obstruct an investigation or legal process.
  • Evade a legal obligation to preserve, disclose or produce material in its unaltered form.
  • Harass, stalk, defraud, impersonate or endanger any person.
  • Violate any applicable law, regulation, court order or third-party right.

Redaction is frequently used to comply with legal and ethical obligations. It can also be misused to defeat them. Where a law, court order, regulator, employer or professional body requires material to be retained or produced unaltered, a redacted copy does not satisfy that requirement, and using the App does not change your obligations. Determining what you may lawfully redact is your responsibility, not ours.

06Detection is assistive, not guaranteed

This section is important. Please read it carefully.

Redactly’s automatic detection is an aid to your judgement, not a substitute for it. Automated detection of faces, on-screen text and license plates cannot be guaranteed to find every instance in every video. Results vary with lighting, motion, resolution, occlusion, angle, image quality and many other factors. License plate detection in particular uses a deliberately conservative approach, and every plate result is flagged for your review.

The App is designed around this reality: it shows you what it found before it changes anything, reports the categories where it found nothing, lets you add regions it missed, and requires you to preview the result before exporting.

You are responsible for reviewing the output and confirming it meets your needs before you publish, share or disclose it. Do not rely on the App as your only safeguard where the consequence of a missed region would be serious — for a source, a patient, a minor, a legal matter or your own safety. Verify the exported file yourself.

07No legal or professional advice

The App and the Site are software and information, not advice. Nothing in either constitutes legal, compliance, medical or other professional advice, and using Redactly does not create any professional relationship between you and us. It does not by itself make you compliant with the GDPR, HIPAA, a public-records regime, a court’s redaction rules, or any other legal standard. If you need to know whether a redacted file satisfies a specific obligation, consult a qualified professional in that field.

08Availability and changes

We may change, suspend or discontinue any part of the Service at any time, and we may update the App to add, alter or remove features. We are not obliged to keep providing the Service, and we do not guarantee that it will be uninterrupted or error-free.

Because the App runs entirely on your device, an installed copy will generally keep working even if we stop distributing it — subject to its compatibility with future versions of iOS, which we do not control.

09Intellectual property

The App, the Site, and all software, design, text, graphics, the Redactly name and the Redactly logo are owned by Piyush Shiyani or its licensors and are protected by copyright, trademark and other laws. These Terms grant you no right to use our names, logos or branding.

Apple, the Apple logo, iPhone and App Store are trademarks of Apple Inc. Redactly is an independent application and is not affiliated with, endorsed by or sponsored by Apple Inc.

10Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind, express or implied. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the App will detect all sensitive content, that its output will meet any particular legal or professional standard, that it will be error-free, or that it will be compatible with any particular device, file or future version of iOS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms limits any non-excludable statutory rights you have as a consumer.

11Limitation of liability

To the fullest extent permitted by law, Piyush Shiyani will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, media, profits, revenue, goodwill or anticipated savings, arising out of or relating to your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages.

This expressly includes any harm arising from content that the App did not detect or did not fully obscure, and from anything that follows from publishing or disclosing a redacted file.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us for the App in the twelve months before the claim arose, or (b) USD $25.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

12Indemnity

You agree to indemnify and hold harmless Piyush Shiyani from any claim, demand, loss or expense (including reasonable legal fees) brought by a third party and arising out of your use of the Service, the content you process with it, or your breach of these Terms or of any applicable law.

13Apple-specific terms

You acknowledge that these Terms are between you and Piyush Shiyani only, not with Apple, and that Apple is not responsible for the App or its content.

  • Apple has no obligation to furnish any maintenance or support for the App.
  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • We, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • We, not Apple, are responsible for investigating and resolving any third-party claim that the App infringes that party's intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right to enforce them against you as a third-party beneficiary.

14Termination

You may end this agreement at any time by deleting the App from your devices. We may suspend or terminate your licence if you materially breach these Terms. Sections that by their nature should survive — including sections 4, 6, 7, 9, 10, 11, 12 and 16 — survive termination.

15Changes to these terms

We may update these Terms. When we do, we will revise the “Last updated” date at the top of this page and publish the new version here. Material changes will be highlighted. Continuing to use the Service after a change takes effect means you accept the revised Terms; if you do not accept them, stop using the Service and delete the App.

16General

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.

These Terms are governed by the laws applicable at Piyush Shiyani’s principal place of business, without regard to conflict-of-law rules, and without depriving you of the protection of any mandatory consumer law of your country of residence.
